According to the United States Drug Enforcement Administration drug overdoses are now the leading cause of injury-related death in the United States, eclipsing deaths from motor vehicle crashes or firearms. Approximately 64,000 Americans lost their lives to drug overdoses in 2016, which was the highest drug death toll and fastest increase in that death toll in American history.
 
This epidemic is being driven primarily by opioids, such as the illegal drug heroin, synthetic opioids such as fentanyl, and pain relievers available legally by prescription.
 
Opioid abuse is linked to problems with workplace productivity and safety. According to a report released in August 2018 by the Massachusetts Department of Public Health (DPH), from 2011 to 2015, construction workers died from opioid overdoses at six times the average rate for all Massachusetts workers.
 
Marijuana (also known as Cannabis) is the most commonly used illicit drug in the United States. Marijuana remains illegal at the federal level as a Schedule I drug under the federal Controlled Substances Act but is legal in Massachusetts. Marijuana can impair cognition, attention and intellectual performance; and employees unfit for work as a result of drug use put themselves and other people at the workplace at risk of harm.

 
Join us for a discussion of changing laws and legal concerns related to opioids and medical marijuana in the workplace. We will review recent court decisions, the interaction between state law and potential conflicts with federal laws and other legal challenges for employers.  Also learn what NAHB is doing to address the opioid epidemic in the home building industry.

David S. Jaffe is Vice President, Legal Advocacy for the National Association of Home Builders in Washington, D.C.  He specializes in industry advocacy in the areas of construction law and risk management.  Mr. Jaffe focuses on identifying legal issues of concern to the building industry and proactively developing effective legal strategies to help builders minimize their liability and improve their business performance.  He is the co-author of Contracts and Liability (5th edition) and is the author of Warranties and Disclaimers for Builders and Warranties and Disclaimers for Remodelers and co-author of Warranties for Builders and Remodelers (2nd edition).
